Valley House, London – London Developer
London Developer (Developer) entered into contract with Large Registered Landlord (RL), part of social housing group Peabody Trust, for the design and construction of 70No apartments in south-east London. A bespoke form of contract was used.
The contract was the subject of significant change and delay and, as a result, various disputes arose during the contract period. Developer claimed circa £4m in additional costs and RL withheld approx. £1.3m in LADs and a further £500k in contra-charges, making the overall disputed amount almost £6m.
MWCS was engaged by Developer to resolve these matters through adjudication. MWCS won £370k in the first adjudication, which revolved around the interpretation of part of the bespoke agreement. Unfortunately – and largely due to the actions of RL – Developer went into Administration before the full extent of the claims could be presented.
Now engaged by the Administrator, all 4 key members of MWCS staff included in this profile, plus others, are actively involved in producing a substantial claim to take to arbitration.
